Відкрита заява УГСПЛ щодо переслідування Сергія Стерненка

Українська Гельсінська спілка з прав людини застерігає Офіс Генеральної прокурора та Службу безпеки України від політичних рішень у ході слідства у так званій справі Сергія Стерненка та вважає кримінальне переслідування активіста політично вмотиваним. 

У трьох кримінальних провадженнях, де Сергій Стерненко є потерпілим, йдеться про три послідовні напади на Сергія, у жодному з яких слідством не встановлені замовники та досі не притягнуті до кримінальної відповідальності виконавці. 

Так, один із підозрюваних у третьому нападі на Сергія Олександр Ісайкул переховується від слідства, проте не оголошений ні в національний, ні в міжнародний розшук. Просувань у провадженнях щодо нападів на Стерненка за останній час не зафіксовано.

Натомість слідчі зосередилися на оголошенні підозри Сергієві, який, не отримавши державної охорони після перших двох нападів, змушений був захищати своє життя та здоров’я і під час третього нападу завдав поранень одному з нападників Івану Кузнєцову, внаслідок яких той помер. Проте слідство відкидає обставини, що передували третьому нападу, а також сам факт замовного нападу, оголошуючи Стерненку підозру навіть не у перевищенні необхідної оборони, а в умисному вбивстві. 

Викликає тривогу правозахисників також інформація про політичний тиск на слідство, що регулярно з’являється в медіа. Так, про тиск у справі Стерненка раніше заявляли колишній Генеральний прокурор Руслан Рябошапка, його заступник Віктор Трепак. Напередодні вручення підозри Стерненку журналісти “Слідство.Інфо” повідомили про те, що Андрій Радіонов, який очолював групу прокурорів у справі, під час засідання Тимчасової слідчої комісії Верховної Ради для здійснення парламентського контролю за розслідуваннями нападів на Катерину Гандзюк та інших громадських активістів розповів, що Генеральний прокурор Ірина Венедіктова тиснула на нього та вимагала підписати підозру Сергію Стерненку, а після відмови Радіонов був відсторонений від справи Стерненка. 

УГСПЛ вважає такі дії очільників правоохоронних органів кричущим порушенням принципів правосуддя. Ми закликаємо Державне бюро розслідувань перевірити та розслідувати озвучену в ЗМІ інформацію щодо політичного тиску у справі Сергія Стерненка. 

Такі рішення і дії зі сторони правоохоронних органів, а тим більше їх очільників, неефективне розслідування та політичний тиск на слідство тягнуть за собою порушення Конвенції про захист прав і основоположних свобод. Багаторічний правозахисний досвід свідчить про те, що рано чи пізно причетність до таких порушень окремих осіб стає явною, а оцінку їм дають міжнародні судові інстанції.

Open statement of Ukrainian Helsinki Human Rights Union regarding the persecution of Serhii Sternenko

Ukrainian Helsinki Human Rights Union warns the Prosecutor General’s Office and the Security Service of Ukraine against political decisions during the investigation in the so-called case of Serhii Sternenko and considers the criminal prosecution of the activist politically motivated.

Three criminal proceedings, where Serhii Sternenko is the victim, involve three consecutive attacks on Serhii. In none of the attacks the investigation has identified instigators. And perpetrators have not been brought to responsibility yet.

Thus, Oleksandr Isaikul, one of the suspects in the third attack on Sergiy, is hiding from the investigation. But he has not been included in the national or international wanted list. There has been no progress in the case regarding attacks on Sternenko recently.

Instead, investigators focused on the announcement of suspicion to Serhii, who had not received state protection after the first two attacks, and was forced to defend his life and health during the third attack. He had injured one of the attackers, namely, Ivan Kuznetsov, who had died as the result. However, the investigation rejects circumstances that preceded the third attack, as well as the very fact of ordered attack. The investigation announces suspicion to Sternenko not even of exceeding the necessary defense, but regarding the intentional murder.

Human rights activists are also alarmed by the information about political pressure on the investigation, which regularly appears in the media. Thus, former Prosecutor General Ruslan Ryaboshapka and his deputy Viktor Trepak had previously stated about pressure in the case regarding Sternenko. On the eve of announcement suspicion to Sternenko, journalists of Slidstvo.Info reported that Andriy Radionov, who headed the group of prosecutors in the case, during the meeting of Temporary Investigation Commission of the Verkhovna Rada for parliamentary control over the investigation of attacks on Kateryna Handziuk and other public activists, told that the Prosecutor General Iryna Venediktova made pressure on him and demanded him to sign the suspicion regarding Serhii Sternenko. Radionov was taken off Sternenko’s case after the refusal.

Ukrainian Helsinki Human Rights Union considers such actions of law enforcement bodies to be a flagrant violation of principles of justice. We call on the State Bureau of Investigation to examine and investigate media reports regarding political pressure in the case of Serhii Sternenko.

Such decisions and actions by law enforcement bodies, and especially by their heads, ineffective investigation and political pressure on the investigation entail violations of the Convention for the Protection of Human Rights and Fundamental Freedoms. Many years of human rights experience show that sooner or later the involvement of individuals in such violations becomes clear. And they will be assessed by international instances.
